OFFICIAL RULES
By purchasing raffle tickets, you agree to be bound by these Official Rules of the raffle (the “Official Rules”).
DATES: The raffle will begin on Thursday, March 9, 2023 and will close on Saturday, March 25, 2023.
HOW TO ENTER: Tickets may be purchased in accordance with these Official Rules by following the instructions at www.bruinsraffles.com (the “Website”) during the dates and times indicated on the Website. Purchasers will receive an email confirmation with their ticket numbers. Purchasing raffle tickets does not guarantee that you will win a prize.
SPONSOR; PROCEEDS: The sponsor of the raffle, the Boston Bruins Charitable Foundation Inc. (hereafter “Sponsor”), is a registered 501(c)(3) non-profit organization having a nonprofit tax ID number of 20-0172439 and a business address at 100 Legends Way, Boston, MA 02114. The net proceeds of the raffle will benefit the Sponsor.
AGE; ELIGIBILITY: The raffle is only open to legal residents located within the Commonwealth of Massachusetts and the State of New Hampshire who are 18 years of age or older. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating in the raffle, each entrant 1) unconditionally accepts and agrees to comply with and abide by the terms and conditions stated in these Official Rules which shall be final and binding in all respects, 2) agrees to be bound by the decisions of Sponsor, and 3) warrants that she/he is eligible to participate. Employees, independent contractors, officers, and directors of Sponsor, and each of their respective affiliates, subsidiaries, advertising, promotion agencies, fulfillment agencies, service providers and legal advisors, and their immediate family members and persons living in the same household, are not eligible to participate. Sponsor shall be entitled to rely upon and interpret these Official Rules as needed, including, without limiting the foregoing, rules regarding entry, entries or other deadlines, winner selection, prize restrictions, and eligibility, and all of Sponsor’s decisions are final and binding in all matters. By participating, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and the decisions of Sponsor and waive any right to claim ambiguity in these Official Rules or any other related advertising or materials. The raffle is void wherever prohibited by law.
PRIZE: One (1) winner (as defined below under “Winner Verification”) of the raffle will receive one (1) Charlie Coyle warm-up worn Irish Heritage jersey (the “Prize”).
The Prize and all portions thereof are awarded “AS IS” and the Sponsor and Released Parties (as defined below under “Release of Liability and Indemnity”) expressly disclaim any warranties, express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose, relating to the Prize in any way. The Prize may not be redeemed for cash. The Prize, or any portion thereof, may be substituted for a similar Prize or portion thereof provided it is of equal or greater value by the Sponsor, at its sole discretion, at any time during the raffle or subsequent thereto. Notice of any changes in the Prize will be added to these Official Rules and will be posted on the Website. Any substituted Prize will also be awarded “AS IS” and the Sponsor and Released Parties (as defined below under “Release of Liability”) expressly disclaim any warranties, express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose, relating to the Prize in any way. Any substituted Prize may not be redeemed for cash.
ODDS OF WINNING: There is no minimum or maximum number of tickets that may be sold. The odds of winning will depend on the total number of valid tickets sold.
RAFFLE TICKET PURCHASES ARE NOT DEDUCTIBLE: The Internal Revenue Service currently does not allow your raffle ticket purchase to be deducted as a charitable contribution for federal income tax purposes. Please consult with your personal tax preparer or consultant if you have additional questions.
RAFFLE TICKETS NON-TRANSFERRABLE: Raffle tickets may not be resold, assigned, or otherwise transferred. All individuals who transfer raffle tickets in violation of these Official Rules may be ineligible to participate in the raffle or to win the Prize and the tickets numbers issued in connection therewith shall be void and ineligible to win.
DRAWING: The winning ticket number will be selected using a random number generator algorithm. The winning ticket number will be posted on the Website immediately after the drawing. The winner will then be contacted by the Sponsor by phone and/or email. If the winner cannot be contacted after reasonable efforts to do so by the Sponsor, or if the winner forfeits the Prize for any reason (as further described herein), the Sponsor shall have the option to use the Prize for future use in accordance with its charitable purposes, or award the Prize to another eligible raffle participant to be verified as the winner.
WINNER VERIFICATION: Sponsor shall have the sole discretion to determine the winner of the Prize and Sponsor’s decision(s) to verify the winner shall be final and binding. Sponsor shall determine: 1) if the winner possesses the winning ticket number; 2) if the winner is eligible to participate in the raffle; and 3) if the winner is not in violation of these Official Rules. Once Sponsor confirms the foregoing requirements, the winner agrees to execute an affidavit of eligibility, to include proof of age. If the Sponsor is unable to verify the identity of the winner, or if the Sponsor is unable to connect with the winner, then the Prize may be deemed forfeited. In the event a Prize is forfeited, the Sponsor shall have the option to use the Prize for future use in accordance with its charitable purposes, or award the Prize to another eligible raffle participant to be verified as the winner.
TAXES: The taxable value of the Prize will be treated as ordinary income to the winner for federal and state income tax purposes, and the winner will be required to pay the tax liability incurred, if any, in connection with his/her receipt of the Prize. If you are the winner, it is important that you determine what federal, state and/or local taxes you must pay and you are encouraged to consult with an attorney, accountant or tax preparer to make that determination.
RELEASE OF LIABILITY AND INDEMNITY: By participating in the raffle or accepting a Prize, entrants and/or winners, both on his or her own behalf and on behalf of each of his or her spouses, assigns, guardians, administrators, executors and legal representatives, hereby release, waive, discharge, covenant not to sue, and indemnify the Sponsor, the Boston Professional Hockey Association, Inc., Delaware North Companies, Inc., the National Hockey League, and their charitable partners, licensors and suppliers, and each of their respective parents, affiliates, subsidiaries, partners, advertising and marketing agencies, service providers, and all of their respective officers, directors, employees, representatives, shareholders, members, consultants and agents (collectively, the “Released Parties”), together with all of the past, present or future predecessors, successors, assigns, parent companies, subsidiaries, affiliates, related entities and persons, owners, shareholders, members, partners, trustees, elected officials, directors, managers, employees, servants, principals, agents, consultants, contractors, representatives, sponsors, and insurers of each of the foregoing from any claim or loss arising out of or related to participation in the raffle, acceptance of the Prize, or any exercise by the Sponsor of any of its rights set forth herein, including, but not limited to, any claims related to (i) any injury to the entrant or winner (including death) or the entrant or winner’s property that occurs in connection with participation in the raffle, receiving and/or using the Prize, or any related activities, (ii) any failure to report and pay any income taxes arising from acceptance of the Prize, and (iii) the entrant or winner’s acts or the acts of any other party with respect to the winner’s receipt of the Prize, or participation in the raffle, regardless of whether any such claims are caused in whole or in part by the negligence of any entity or person released hereunder.
RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE PRIZE OR ANY PORTION THEREOF. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE RAFFLE OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF THE PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE RAFFLE.
PUBLICITY RELEASE: By accepting the Prize, the winner hereby grants Sponsor and Sponsor’s designees and affiliates, including its charitable partners, licensors, service providers, suppliers, permission to use the winner’s name, likeness, photograph, video, voice and Prize information for advertising and marketing purposes without further notice and without further compensation, on the Website and in all social media channels of the Sponsor, in the Sponsor’s sole discretion.
PRIVACY: In order to participate in the raffle, entrants will be required to supply certain information about themselves on the Website entry pages. Sponsor has specified on the Website which information is mandatory in order to participate. This information will be used by Sponsor for the purposes of administering the raffle, and may be shared with its respective affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, legal advisors, service providers and partner charities. Entrant’s information will be collected, processed and used in accordance with Sponsor’s privacy policy.
GOVERNING LAW; SEVERABILITY; WAIVER: The raffle shall be subject to and governed by the laws of the Commonwealth of Massachusetts. If a court of competent jurisdiction finds that any provision of these Official Rules is invalid or unenforceable, then the remainder of these Official Rules shall not be affected by that determination and shall remain enforceable. The failure of Sponsor to enforce at any time any provision of these Official Rules shall not be considered a waiver of such provision or any other provision and shall not deprive Sponsor of the right thereafter to enforce such provision or any other provision.
NOTICE: Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the raffle in violation of these Official Rules and/or in violation of criminal and/or civil law.
WINNING TICKET NUMBER; OFFICIAL RULES: For a copy of these Official Rules or the winning ticket number, visit the Website at www.bruinsraffles.com or mail a self-addressed stamped envelope to: Boston Bruins Charitable Foundation Inc., 100 Legends Way, Boston, MA 02114 specifying the name of the raffle and either “Official Rules” or “Winning Ticket Number.”
DEPOSITING RAFFLE TICKETS OR RELATED MATERIALS IN THE FEDERAL MAILS IS A VIOLATION OF FEDERAL LAW AND COULD LEAD TO CRIMINAL PENALTIES. ALL RAFFLES ARE VOID WHERE PROHIBITED BY LAW.
COPYRIGHT: All raffle materials are the property of the Sponsor and copyrighted by the Sponsor. Raffle materials may not be used or reproduced for any purpose whatsoever without Sponsor’s express prior written consent.
Sponsor logos are trademarks of the Sponsor. Any other logos, names or trademarks referenced in these Official Rules are used for charitable partner or prize identification purposes only and are the properties of their respective owners.
